1. Authority and Acceptance
1.1 By booking with APS, handing over a vehicle, or otherwise using our services, the customer (“you”) agrees to these Terms & Conditions.
1.2 You confirm that you are either the legal owner of the vehicle or fully authorised by the owner to bind them to these terms.
1.3 These terms apply to any vehicle entrusted to APS Valet Services (Pty) Ltd.
2. Scope of Service and Definition of Valet Parking
2.1 APS provides valet parking, defined exclusively as the collection, controlled movement, secure storage, and return of a motor vehicle at Cape Town International Airport.
2.2 Valet Parking does not include detailing, polishing, or cosmetic cleaning services.
2.3 The customer is charged solely for parking and storage, not for cleaning.
3. Complimentary Wash & Vacuum (Optional)
3.1 APS may provide a complimentary wash and vacuum as a goodwill benefit.
3.2 This complimentary service is: optional, not guaranteed, and does not form part of the paid valet service.
3.3 The timing, outcome or completion of cleaning shall not entitle the customer to a refund, discount or complaint.
3.4 APS may omit cleaning due to operational conditions without affecting valet fees.
3.5 APS does not perform vehicle washing or vacuuming on Sundays or public holidays, and no complimentary cleaning shall be available on those days, regardless of booking duration or vehicle condition.
3.6 If a customer’s return time is amended 12 hours prior to arrival back to Cape Town the vehicle shall not qualify for complimentary wash and vacuum.
3.7 Changes to return time, flight delays, rescheduling or early/late collection do not entitle the customer to a refund, discount or complaint in respect of complimentary cleaning.
4. APS Role and Standard of Care (Limited Liability)
4.1 APS will take reasonable care in handling vehicles, as expected under South African common law.
4.2 APS does not assume the duties of: an insurer, a bailee beyond reasonable care, a custodian, a repair, maintenance or security provider.
It is the customer’s responsibility to inform his/her insurance to inform them if they are making use of Valet Parking.
4.4 Use of APS services is at the customer’s risk, except where APS negligence is proven.
5. Vehicle Movement and Storage
5.1 Vehicles are collected and returned at Cape Town International Airport.
5.2 Vehicles will be transported to and stored at an APS-operated off-site facility for safekeeping and cleaning where applicable.
6. Vehicle Condition, Visibility of Defects & Inspection
6.1 APS conducts a visual intake inspection; visible marks may be recorded.
6.2 Dirt, dust, grime and lighting may conceal existing defects on arrival.
6.3 APS is not responsible for pre-existing damage or damage visible only after cleaning.
6.4 Customers must inspect their vehicles immediately on return.
6.5 Claims raised after the vehicle leaves airport premises will not be accepted.
7. Release of Vehicles
APS may release a vehicle to a person who:
(a) presents a valid APS voucher, or
(b) provides identity or authority APS reasonably accepts.
APS may withhold release if proof cannot be verified.
8. Charges, Retention and Lien
8.1 Parking fees apply for the full period a vehicle remains in APS custody, including delays or rescheduled flights.
8.2 APS retains a general lien over the vehicle and its contents until all charges are paid.
8.3 Daily storage fees may apply until settlement.
9. Limited Liability
9.1 APS will only be liable where loss or damage is directly caused by APS negligence.
9.2 To the fullest extent allowed by South African law, APS shall not be liable for theft, attempted theft, vandalism, criminal acts by third parties, mechanical or electronic problems, tyre punctures, stone chips, wear and tear, items left in a vehicle, or indirect or consequential loss.
9.3 APS does not accept limited liability for gross negligence, theft or malicious acts committed by unauthorised third parties outside APS control, subject always to the CPA.
9.4 This clause complies with the Consumer Protection Act.
10. Customer Indemnity
The customer indemnifies APS, its staff and contractors against any claims arising from the vehicle or its contents, except where APS negligence is proven.
11. Insurance Disclosure & Responsibility
11.1 The customer confirms that their insurer has been notified that APS will take custody of the vehicle, APS drivers may move the vehicle short distances, and the vehicle will be stored off-site.
11.2 The customer is responsible for maintaining insurance and for excesses, deductibles or uninsured losses.
11.3 APS is not liable if a claim is rejected by the insurer due to policy terms, exclusions or non-disclosure.
12. Personal Property
APS accepts no liability for items left in the vehicle including cash, cards, electronics, sunglasses, tools, shopping bags or valuables. Customers must remove ALL personal belongings before handover.
13. Force Majeure
APS is not liable for any delay or failure arising from events beyond its control, including loadshedding, utility failure, airport restrictions, protests, riots, malicious acts, extreme weather, natural disasters, strikes, system breakdowns, or legal or regulatory intervention.
14. Public Communications & Reviews
14.1 The customer acknowledges that valet parking is the paid service and cleaning is complimentary.
14.2 Dissatisfaction relating solely to the complimentary wash cannot form the basis of a service complaint.
14.3 APS reserves the right to request amendment or removal of public reviews or statements that are misleading, defamatory, or inconsistent with these terms.
14.4 APS may provide these terms to online platforms as evidence of the agreed scope of service.
15. Park Points Loyalty Programme
15.1 Park Points apply only to standard valet parking rates.
15.2 Park Points may be earned and redeemed only by the individual customer who accumulated them.
15.3 Park Points have no cash value and cannot be exchanged, refunded or converted into money or credit.
15.4 Customers must provide notice 24 hour prior to departure via email info@flyaps.co.za to APS if they wish to redeem Park Points on a booking.
15.5 Park Point balances are available on request by emailing info@flyaps.co.za.
15.6 Park Points expire annually, are not transferable, and do not roll over to the following year.
15.7 Park Points cannot be deducted from invoices or applied retrospectively.
15.8 Park Points apply only to bookings made directly through the APS website (www.flyaps.co.za) or linked corporate accounts that have requested to be part of it.
15.9 Park Points do not apply to third-party platforms, brokered or wholesale bookings, promotional or long-term discounted rates.
16. APS Vouchers & Discount Codes
16.1 APS-issued vouchers and discount codes are redeemable only via the APS website.
16.2 Vouchers and discount codes cannot be exchanged for cash, sold, transferred, duplicated or combined unless authorised by APS.
16.3 APS reserves the right to cancel, withdraw or decline any voucher suspected of misuse or fraud.
17. Variations
APS may amend these Terms & Conditions without prior notice. The version published on this website is the current and enforceable version.
18. Governing Law
These Terms & Conditions are governed by South African law and disputes fall under the jurisdiction of South African courts.
19. Acceptance
By reserving parking, handing over a vehicle, or signing APS’s reservation form, the customer confirms they have read, understood and accepted these Terms & Conditions in full.
